Swap.com’s List Your Way to $1k Giveaway Official Rules

ELIGIBILITY: You must be a legal resident of the United States, physically reside in the United States, and be at least 18 years old to enter this Contest. To be eligible for the Contest, you must be a member of and have registered for Swap.com at www.swap.com. This Contest is void where prohibited or otherwise restricted by law, including but not limited to any jurisdictions with laws that would require registration, disclosure, filing, trust account, or posting of a bond, or any other requirements, that are not satisfied by these terms and conditions. Employees and directors of Swap.com and its parent, affiliates and advertising and promotional agencies and each of their immediate family members or members of the same households of such employees and directors are not eligible. By entering the Contest, you agree to these Official Rules and the decisions of Swap.com or its designee, which are final and binding in all respects.

CONTEST DESCRIPTION: Swaptree, Inc. (“Swap.com”) is running this contest (the “Contest”) to encourage its members to list all the items they Have to swap on Swap.com.com. Cash prizes of $1,000 each will be awarded to the member who creates the Best Haves List.

CONTEST PERIOD: The Contest begins on December 26, 2011 at 12:01 AM EST and will end on January 28, 2012 at 11:59 PM ET.

ENTRY: To register for the Contest, during the Contest period members must simply add an item to their Haves at www.swap.com and accept the rules and regulations (an “Best Haves List”).

WINNER SELECTION/JUDGING CRITERIA: Two winners, one male and one female, will be selected. The judges will be leading creative professionals in the swapping industry and will judge Best Haves Lists based on their quality, quantity, diversity, popularity, and creativity.

PRIZES/WINNER NOTIFICATION: Two winners will win a cash prize of $1,000 (“Prize”), subject to submission of an Affidavit of Eligibility and Liability and Publicity Release. Only one Prize per entrant is allowed. No substitution of the Prize is permitted, and taxes are the sole responsibility of the Winner. Winners will be notified by email and via social media around February 1, 2012.

ODDS: Odds of winning depend on the number of eligible entries received.

GENERAL CONDITIONS: Except where prohibited by law, acceptance of a Prize constitutes permission for Swap.com and its agents to use the Winner’s name, statements, biographical information, image, and/or likeness for advertising and trade purposes without further compensation in any and all forms of media including, without limitation, online and in blog posts.

Swap.com reserves the right, at its sole discretion, to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or violates these Official Rules.

Swap.com reserves the right to cancel, terminate, modify, or suspend this Contest at its discretion for any reason including, but not limited to fraud, technical failures or any other causes beyond its control.

By accepting a Prize, entrants release Swap.com and other entities associated with this Contest (including their parents, affiliates, subsidiaries, officers, directors, representatives, agents, and employees) from any and all liability for any claims, costs, losses, injuries or damages arising out of, resulting from or in connection with the Contest (including, but not limited to, (i) submission of any Contest entries, including misdirected, lost or incomplete entries, (ii) acceptance, possession, or use of the Prizes (including, but not limited to, claims, costs, losses, injuries or damages related to personal injuries, death, rights of publicity or privacy, defamation, or portrayal in a false light), (iii) participation in the Contest, or (iv) any technical malfunction of the telephone network, computer online system, computer time or date mechanism, computer equipment, hardware or software, program malfunctions or technical errors, or any combination thereof, or any lost, garbled, misdirected, illegible, or delayed data transmissions).

This Contest is governed by the laws of the United States and the State of Massachusetts without regard to conflict of laws provisions thereof. Any dispute arising hereunder shall be subject to jurisdiction in the State of Massachusetts, U.S.A. If any provision of these Official Rules is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law. No waiver to these Official Rules will be effective unless in writing and signed by the party against which enforcement is sought.

To the maximum extent permitted by law, Swap.com.com reserves the right to change these Official Rules at any time by posting an amendment on www.swap.com.
